Terms of Service

By using prosnearby.com, submitting a match request, or applying to join the pro network, you agree to these Terms. If you are accepting on behalf of a business, you represent that you have authority to bind that business.

ProsNearby is a referral and matching platform. We connect homeowners with vetted local home-service pros. We are not a home-service contractor, we do not perform the work, and we are not a party to any contract between a homeowner and a pro. All hiring, scoping, pricing, scheduling, payment, and dispute resolution happens directly between you and the pro.

• Use of the matching service is free for homeowners.
• You agree to provide truthful information when submitting a job request.
• Quotes and timelines provided by pros are estimates only and may change once the pro inspects the job.
• You are responsible for vetting any pro you choose to hire, signing your own agreement with them, and resolving any issues that arise from the work performed.
• You may ask us to remove your information from a pro's queue at any time by emailing jon@aisoiq.com.

• Pricing for leads, subscriptions, and any other paid features is set out in your written agreement with ProsNearby.
• You must maintain a valid license and active insurance for every trade and jurisdiction in which you accept leads.
• You agree to respond to delivered leads promptly and in good faith.
• You may request a credit on a verifiably bad lead (e.g. fake contact info, duplicate, out of service area) per the credit policy in your agreement.
• You may not bypass the platform by re-routing matched homeowners off ProsNearby to avoid lead fees.

We screen pros before adding them to the network, but we do not guarantee the quality, safety, timing, pricing, licensing, insurance status, or outcome of any work performed by a pro. The matching service is provided "as is" without warranties of any kind. You are responsible for your own due diligence before hiring any pro.

ProsNearby owns the platform, the ProsNearby name and marks, and all site content we create. You retain ownership of the content you submit (job descriptions, business profile content, reviews) and grant us a worldwide, royalty-free license to use it to operate the matching service and to feature it on the site.

You may not, and may not allow any third party to:

• Scrape, copy, or harvest data from the site for any commercial purpose.
• Submit false, misleading, or fraudulent match requests or applications.
• Harass, threaten, or otherwise abuse other users.
• Reverse-engineer, decompile, or interfere with the platform's operation.
• (Pros) circumvent the platform by accepting a matched lead and then handling future work for that homeowner off-platform to avoid lead fees.

The site and matching service are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

To the maximum extent permitted by law, ProsNearby will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any work performed (or not performed) by a pro. Our aggregate liability arising out of or relating to the service is capped at: (a) US$100 for homeowner users, and (b) the fees you paid us in the 6 months preceding the claim for pro users.

You agree to indemnify and hold harmless ProsNearby from any claim, damage, or expense arising out of your use of the service, your interaction with a homeowner or pro, or your breach of these Terms.

These Terms remain in effect while you use the service. You may stop using ProsNearby at any time. We may suspend or terminate your access at any time for breach of these Terms or for any abuse of the platform.

These Terms are governed by the laws of the state in which ProsNearby is organized, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in that state.

We may update these Terms. Material changes will be posted at this URL. Continued use of the site or service after a change constitutes acceptance.
